DFL und Schalke 04 klagen gegen Online Ticketverkauf
Die Deutsche Fußball Liga und Schalke 04 werden nach dem jüngsten Gerichtsurteil, um den Ticketverkauf über das Internet, in Berufung gehen. Das teilte nun Schalkes Geschäftsführer der deutschen Presse Agentur mit. Vorausgegangen war ein Gerichtsurteil des Essener Landgericht, welches vorsah, dass Tickets welche über eine Online Plattform verkauft wurden, nicht Ihre Gültigkeit verlieren dürfen. Grund für die Gerichtsverhandlung bestand in der Tatsache, dass Schalke 04 Eintrittkarten aus Online Plattformen entwertete. Sollte der Verein weiterhin diese Karten nicht akzeptieren, droht diesem ein Bußgeld von bis zu 250.000 Euro. Mit seinen aktuellen Urteil, folgt das Essener Landgericht dem Urteil des Bundesgerichtshof. Dieser wies darauf hin, dass Tickets Ihre Gültigkeit behalten, auch wenn die Geschäftsbedingungen eines Vereins, ein Veräußerungsverbot besitzen. Aussagen wie zum Beispiel „Die Karten verlieren Ihre Gültigkeit bei einem Weiterverkauf. Die Tickets behalten weiterhin Ihre Gültigkeit. Sowohl Schalke 04 als auch die DFL haben bedenken, dass eine Erlaubnis des Ticketverkaufs über Online Plattformen, den Verkauf von gefälschten Karten unterstütze und fördere.
